TERMS AND CONDITIONS OF SALE

ARTICLE 1 — SCOPE

These Terms and Conditions of Sale apply to all 
sales concluded on the website shop.9mm-energy.com between:

Seller: 9MM Europe, SAS with share capital of 10 000 €, 
128 rue La Boétie 75008 Paris — RCS Paris 993 313 758
Contact: contact@9mm-energy.com

And: any consumer or business customer (hereinafter "the Customer") 
making a purchase on the website.

Placing an order constitutes full and unconditional acceptance of these Terms and Conditions of Sale.

ARTICLE 2 — PRODUCTS
───────────────────────────────────────

The products sold are non-alcoholic energy drinks 
(9MM Active Body, 9MM Active Mind), together with associated packs.

The essential characteristics of each product are described on the 
product pages. Photographs are provided for illustration purposes and are not 
contractually binding. 9MM Europe reserves the right to change the composition 
of its products, provided that they remain compliant with applicable regulations.

In accordance with European regulations, the caffeine content is 
stated on the label. The wording "High caffeine content" is 
displayed where applicable.

ARTICLE 3 — PRICES
───────────────────────────────────────

Prices are stated in euros (€), inclusive of all taxes, excluding 
delivery charges. The applicable VAT is the French VAT rate in force.

9MM Europe reserves the right to change its prices at any time. 
The applicable prices are those displayed when the order 
is confirmed.

Delivery charges are specified during the ordering process.

ARTICLE 4 — ORDERS
───────────────────────────────────────

The Customer places an order online through the website. The order is confirmed 
after:
1. Selecting products and adding them to the cart
2. Signing in or creating an account
3. Entering the delivery address
4. Choosing the delivery method
5. Accepting these Terms and Conditions of Sale
6. Confirming payment

A confirmation email is sent upon receipt of payment. 
9MM Europe reserves the right to refuse any order in the event of 
a previous dispute, suspected fraud or unavailable stock.

ARTICLE 5 — PAYMENT
───────────────────────────────────────

Payment is made securely online by:
- Payment card (Visa, Mastercard, American Express)
- Any other method offered during checkout

Transactions are secured using SSL encryption and processed by 
Shopify Payments. 9MM Europe does not retain any banking details.

Payment is taken when the order is confirmed.

ARTICLE 6 — DELIVERY
───────────────────────────────────────

Orders are dispatched from France within 24 to 48 working hours 
after payment has been confirmed.

Indicative delivery times:
- Metropolitan France: 3 to 5 working days
- Belgium and Luxembourg: 4 to 6 working days

A tracking email is sent upon dispatch. In the event of a delay attributable 
to the carrier, 9MM Europe cannot be held liable but undertakes 
to make every effort to resolve the dispute.

If no one is present at the time of delivery, the parcel is left at a collection point 
or a delivery notice is left.

ARTICLE 7 — RIGHT OF WITHDRAWAL
───────────────────────────────────────

In accordance with Articles L.221-18 et seq. of the French Consumer Code, 
the Customer has 14 calendar days from 
receipt of the product to exercise their right of withdrawal, without having 
to give a reason or incur a penalty.

To exercise this right, the Customer must notify their decision by email to:
contact@9mm-energy.com (subject: "Withdrawal — order no.XXX")

Products must be returned:
- In their original packaging, unopened and unconsumed
- Within 14 days of notification of withdrawal
- Return costs are payable by the Customer

The refund is made within 14 days of receipt of the 
returned products, using the original payment method.

Statutory exception: in accordance with Article L.221-28 of the French 
Consumer Code, the right of withdrawal cannot be exercised for 
food products that are rapidly perishable or whose date of minimum durability 
(best-before date) has passed.

ARTICLE 8 — RETURNS AND REFUNDS
───────────────────────────────────────

Any product that is defective, damaged in transit or does not conform to the 
order must be reported within 48 hours of receipt to:
contact@9mm-energy.com, with supporting photographs.

9MM Europe will provide a replacement or a full refund, including 
return costs, for any product confirmed to be defective.

ARTICLE 9 — STATUTORY GUARANTEES
───────────────────────────────────────

The products are covered by the statutory guarantee of conformity 
(Art. L.217-4 et seq. of the French Consumer Code) and the guarantee 
against hidden defects (Art. 1641 et seq. of the French Civil Code).

ARTICLE 10 — LIABILITY AND WARNINGS
───────────────────────────────────────

9MM drinks contain caffeine (70 mg / 250 ml).
Recommendation: a maximum of 2 cans per day for a healthy adult.

Not recommended for:
- Pregnant or breastfeeding women
- Children and adolescents under 16
- People sensitive to caffeine
- People with heart conditions

9MM Europe cannot be held liable for consumption that does not 
comply with the recommendations on the label.

ARTICLE 11 — PERSONAL DATA

Data collected when an order is placed is processed in accordance with the 
GDPR. Please refer to our Privacy Policy for more information.

ARTICLE 12 — GOVERNING LAW AND DISPUTES
───────────────────────────────────────

These Terms and Conditions of Sale are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal 
proceedings. The Customer may also refer the matter to a consumer 
mediator or to the European online dispute resolution platform:
https://ec.europa.eu/consumers/odr

If no amicable solution is reached, the courts within the jurisdiction of the Tribunal des 
Activités Économiques de Paris shall have exclusive jurisdiction.
